3. Conclusion of the Agreement

  • The presentation of goods on Afrolace.com with accompanying price information is not a legally binding offer.
  • Customers submit a legally binding offer to purchase by placing an order through the shopping basket and paying the purchase price. The agreement is concluded when Shadow dispatches the goods to the customer.
  • Orders placed via telephone become binding only when confirmed in writing by Shadow.
  • If goods are unavailable in the requested quantity or at the listed price, Shadow will notify the customer. The agreement is established only after the customer confirms the revised details in writing and pays the updated purchase price.
  • The customer is not entitled to revoke the agreement once it is concluded.

4. Goods, Prices, and Delivery Charges

  • All details regarding goods are subject to confirmation and are non-binding. Variations between goods and their descriptions or illustrations may occur.
  • Prices are listed in AED and include packaging costs but exclude additional taxes, customs duties, and transport costs, which the customer must bear.
  • The applicable price is the one displayed at the time of payment.

5. Payment and Delivery

  • Payments are accepted via credit card and other payment methods listed on the website.
  • Goods are dispatched only after payment is received. Delivery timelines provided are estimates and not binding.
  • Deliveries are made at the customer’s risk and expense. Risk transfers to the customer when the goods are handed over for shipment.
  • The customer must obtain any necessary import licenses or make other arrangements for accepting the goods. Failure to accept goods on time may result in Shadow storing or retrieving the shipment at the customer's expense.
  • Partial deliveries are permitted, with Shadow covering any additional costs.

6. Warranty

  • The customer must inspect goods upon arrival and report any defects within seven days. Complaints must include a valid payment address.
  • If the claim is justified, Shadow will either replace the goods or refund the purchase price within ten days of the complaint.
  • No other claims, such as price reduction, cancellation, or compensation, are accepted.

7. Retention of Title

  • Ownership of the goods remains with Shadow until all amounts under the agreement are paid in full.
  • Goods under retention of title cannot be pledged or assigned as security. If sold before full payment, the customer assigns any claims against third parties to Shadow.

8. Data Protection

  • Shadow employs robust security technology to protect customer data but assumes no liability for data breaches during internet transmission. Data is transferred in unencrypted form unless otherwise specified.

9. Intellectual Property

  • All content on Afrolace.com, including images, text, and designs, is the property of Shadow and protected under intellectual property laws. Unauthorized use, reproduction, or distribution is prohibited.

10. Limitation of Liability

  • Shadow is not liable for indirect, incidental, or consequential damages arising from the use of the website or products purchased. Liability is limited to the purchase price of the goods in question.

11. Final Provisions

  • Shadow reserves the right to amend these GTCs at any time. Changes will be effective upon publication on Afrolace.com.
  • If any provision of these GTCs is deemed invalid, the remaining provisions will remain in effect.
  • These GTCs and all legal relationships between the customer and Shadow are governed by UAE law. The courts of Dubai, UAE, shall have exclusive jurisdiction over any disputes.
